17.建设项目环评由哪一级别的生态环境主管部门审批？
建设项目环评的审批权根据具体类型、规模和地理位置进行判断，具体如下[19、30]：
（1）列入部级审批目录的建设项目由生态环境部审批。
（2）建设地点位于自由贸易试验区保税区、自由贸易试验区临港新片区（不包括洋山保税港区岛屿部分）、浦东新区（自由贸易试验区保税区、自由贸易试验区临港新片区除外）范围内的建设项目分别由中国（上海）自由贸易试验区管理委员会保税区管理局、中国（上海）自由贸易试验区临港新片区管理委员会和浦东新区生态环境局负责审批（海洋工程除外）。
（3）列入上海市级审批目录的建设项目（建设地点位于自由贸易试验区保税区、自由贸易试验区临港新片区、浦东新区除外）由上海市生态环境局审批，其他建设项目由所在地的区生态环境局审批。
17. Which level of ecological environment department approves the construction project EIA?
The approval authority for construction projects EIA is judged based on the specific type, scale, and geographical location. Details are as follows [19, 30]:
(1) Construction projects listed in the Ministerial Approval Directory are approved by the Ministry of Ecology and Environment.
(2) Construction projects located within the China (Shanghai) Pilot Free Trade Zone Bonded Area, Pilot Free Trade Zone Lingang Special Area (excluding Yangshan Bonded Port Area islands), and Pudong New Area (excluding FTZ Bonded Area and Lingang Special Area) are approved by the China (Shanghai) Pilot Free Trade Zone Administration Bonded Area Administration, China (Shanghai) Pilot Free Trade Zone Lingang Special Area Administration, and Pudong New Area Bureau of Ecology and Environment, respectively (excluding marine engineering projects).
(3) Construction projects listed in the Shanghai Municipal Approval Directory (excluding those located in the FTZ Bonded Area, Lingang Special Area, and Pudong New Area) are approved by the Shanghai Municipal Bureau of Ecology and Environment. Other construction projects are approved by the Bureau of Ecology and Environmentin local District.
18.建设单位如何申请环评审批？
建设单位可登录上海市政府网站，在“一网通办”栏目中的“建设项目环境影响评价审批”模块，在线填写审批申请表并上传电子版申请材料。建设单位可以在“一网通办”栏目中在线查询事项办理进度。
18.How does a construction unit apply for EIA approval?
You can log in to the Shanghai Government Website, enter the "Construction Project Environmental Impact Assessment Document Approval" module in the "Government Online-Offline Shanghai", fill in the approval application form online, and upload the electronic version of the application materials. The construction unit can query the EIA approval progress online in the "Government Online-Offline Shanghai".
19.环境影响报告书（表）审批流程是什么，审批时间需要多久？
建设单位需在上海“一网通办”选择“建设项目环境影响评价审批”模块，在线提交申请材料。申请材料包括环评文件全本及可公开版本、建设项目环评审批基础信息表、总量来源说明（若需）、建设项目环境影响评价文件行政审批告知承诺书（若需）。
环评审批部门对提交的材料进行审查，依法做出受理决定。受理后，将进行受理公示，报告书项目公示期为10个工作日，报告表为5个工作日。环评审批部门依法对申请材料进行审查，并可委托第三方机构开展技术评估。在做出行政许可决定前进行5个工作日的拟审批公示。公示无异议后，环评审批部门做出行政许可决定并进行审批决定公示。环评报告表的承诺办结时限为自受理之日起7个工作日、环评报告书的承诺办结时限为自受理之日起15个工作日，以上均不含法定公示时间和技术评估时间，各区的办结时限详见各区“一网通办”办事指南。采用告知承诺审批的可实现当场办结。
19.What is the approval process for the Environmental Impact Report (Form), and how long does the approval take?
The construction unit needs to select the "Construction Project Environmental Impact Assessment Approval" module in "Government Online-Offline Shanghai" and submit application materials online. Materials include: Original and Public Version of EIA Document, Construction Project EIA Approval Basic Information Form, Explanation of Total Quantity Source (if required), and Construction Project EIA Document Administrative Approval Notification Commitment Letter (if required).
The EIA approval department will review the submitted materials and make a decision on acceptance in accordance with the law. After acceptance, a public notice of acceptance will be issued. The public notice period for the EIA report is 10 working days, and for the EIA form, it is 5 working days. The EIA approval department reviews the application materials in accordance with the law and may entrust a third-party institution to conduct technical assessments. A five-working-day public notice for proposed approval is issued before making an administrative decision. After the public notice receives no objections, the EIA approval department makes the administrative decision and issues a public notice of the approval decision. The promised processing time limit for the EIA form is 7 working days from the date of acceptance, while the promised processing time limit for the EIA report is 15 working days from the date of acceptance. The above does not include statutory public notice time and technical assessment time. For details on the processing time limits in each district, please refer to the "Government Online-Offline Shanghai" guide in each district.The approval process adopting the notification and commitment method can be completed on the spot.
20.建设项目环评批复是否具有有效期限？
环评批复后，自批准之日起五年后才开工建设的，其环评报告书（表）需要重新审核[20]。
20.Does the construction project EIA approval have a validity period?
If the project does not start construction within five years from the date of approval, its EIA Report (Form) needs to be re-verified [20].
